How Do We Work Through a Complex Matter?

We do not start by drafting. We first work out what happened. Massud and Jessie read the records, test the dates, identify gaps, separate fact from assumption, then build a practical plan.

Step 1: Secure & Preserve

We collect the primary records before memories shift or files disappear: notices, emails, lodgements, invoices, call notes, policies, system records, instructions and prior submissions.

Step 2: Build the Chronology

Jessie Emily Zhouand and Massud Zhouand test the dates against the source documents. We record what is known, what is disputed, what is missing and why each point matters.

Step 3: Prepare the Briefing

We create an indexed pack, a clear chronology and the written material needed for the next stage. We coordinate with the client’s lawyer, accountant, tax adviser, restructuring practitioner or other qualified professional where required.

Why Does Early Administrative Work Matter?

One missed date, unsupported statement, missing attachment or unexplained gap can change how a regulator or adviser reads the entire matter. ASIC recorded 3,388 small business restructuring appointments between 1 July 2022 and 31 December 2024. Of the proposed plans sent to affected creditors, 87% were approved. The ATO states that a Director Penalty Notice gives a director 21 days from the day the notice is posted or left at the registered address to take an available remission option. These are formal processes. Good records, early action and qualified advice matter.

Can a company use small business restructuring to deal with tax debt?

Tax debt may form part of a small business restructuring plan where the company is eligible. Tax lodgements, employee entitlements, creditor information and the proposed plan require careful professional assessment. Advice on eligibility and the plan must come from a registered restructuring practitioner and the appropriate tax adviser. Connect Australia helps organise the records and briefing material.

What is the timeframe for a Director Penalty Notice?

The ATO states that the 21 days starts on the day it posts the Director Penalty Notice or leaves it at the address registered with ASIC. Available remission options depend on the liability and when it was reported. Immediate legal, tax or insolvency advice may be required.
